Directive on the Training of Aspirant Lawyers (Training Directive - RL-RAA)

Pursuant to § 37 (1)(3) RAO (Austrian Lawyer's Act) the following is decreed:

§ 1

(1) Aspirant lawyers shall be required to complete an educational programme comprising a minimum of 42 half-day training units.

(2) Pursuant to § 2 (2) RAPG (Law relating to the Examination of Lawyers), a minimum of 24 half-day training units shall be completed before the bar exam can be taken.

(3) The Law Societies shall assess the participation of an aspirant lawyer in training events to the extent of at least twelve half-days as grounds worthy of consideration in accordance with § 15 (2) RAO.

§ 2

(1) Training courses are meant to prepare aspirant lawyers for the bar exam and to complement their training as a lawyer. Their aim is to provide them with the abilities and knowledge within the meaning of the requirements laid down in § 1 RAPG, taking account of the subjects of the bar exam pursuant to § 13 RAPG and § 20 RAPG.

(2) In order to be credited a half-day training unit shall comprise at least three hours.

§ 3

Pursuant to § 28 (1) RAO, the Law Societies shall only recognize training events as training courses if they meet the criteria laid down in § 2 and if they are held in their districts.

§ 4

Pursuant to § 21b RAO, lawyers shall permit any aspirant lawyers working with them as trainees to attend the minimum compulsory training courses as provided for by this Directive.

§ 5

Proof of attendance at compulsory training events is to be provided in writing. This proof shall include:

1. Organizer and lecturers;

2. Topic and nature of the training event;

3. Date and duration of the training event; and

4. Proof that a Law Society has acknowledged a training event organized in its district but not under its auspices, in accordance with § 28 (1)m) RAO.

§ 6

The Law Society of the district in which the aspirant lawyer is registered or was last registered shall confirm in accordance with § 7 RAPG that the preconditions for taking the bar exam as stated in § 2 (2) RAPG have been fully met.

§ 7

(1) This Directive (RL-RAA) shall come into effect upon its publication. At the same time, the Directive on the Training of Aspirant Lawyers (Training Directive), as last amended by decision of the Representative's Assembly of 22.4.2005, published in the Amtsblatt zur Wiener Zeitung (Official Gazette) on 14.2.1993 and on the website of the Österreichischer Rechtsanwaltskammertag (http://www.rechtsanwaelte.at) on 22.4.2005, shall cease to have effect.

(2) The RL-RAA shall be made available permanently on the website of the Österreichischer Rechtsanwaltskammertag (http://www.rechtsanwaelte.at).
